RE:
Advisory opinion as to whether Fred Wherland may obtain employment as a hearing representative/employer advocate in the same type of hearings he presided over as an administrative law judge.
Facts:
As of August 5, 2011, Mr. Wherland is no longer employed with the Louisiana Workforce Commission after 33 years of service.
Prior to his retirement he served as an Administrative Law Judge where he conducted appeals hearings on Unemployment Insurance Benefit cases as to whether claimants were eligible for such benefits. He stated that he was not an agency head during his time with the LA Workforce Commission. He would now like to obtain employment as a hearing representative/employer advocate in the same type of hearings. According to his opinion request he will not be involved with a case in which he had dealt with in the past as an Administrative Law Judge.

Law:
Section 1121B of the Code states that no former employee shall, for a period of two years assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, where he participated at any time during his employment and the agency he was employed by.





Recommendations:
Adopt proposed advisory opinion.
