In connection with his request for a waiver of the $2,000 assessed for the late filing of the 10-G campaign finance report, Alan J. Yacoubian, on behalf of Mark Jacobs, states that the candidate timely filed his report on paper form on the date the report was due. He further states that the candidate did not know he was required to electronically file his report, and that per Section 42:1157(B), the candidate did not receive a delinquency notice within four (4) days after the due date of the 10-G campaign finance disclosure report.

Mr. Yacoubian maintains it was not until December that the candidate received notice of his requirement to electronically file his report. The report was immediately electronically filed upon receipt of notice. Mr. Jacobs is a district level candidate. This is his first election. He was a successful candidate.
Law:
Effective January 1, 2010, Act 25 of the 2008 1st Extraordinary Session requires major and district office level candidates with more than $25,000 in contributions/loans or more than $25,000 in expenditures in connection with a specific election to electronically file campaign finance disclosure reports. A report is not considered filed until it is filed electronically.

Recommendations:
Reduce to $100.
