Bertrand <br /> Assistant District Attorney <br /> Allen Parish <br /> Post Office Box 839 <br /> Oberlin, Louisiana 70655 <br /> Re: Ethics Board Docket No. 2013-1048 <br /> Dear Mr. Bertrand: <br /> The Louisiana Board of Ethics, at its August 16, 2013 meeting, considered your request for an <br /> advisory opinion as to whether Womack Construction may enter into a contract with the West Allen <br /> Parish Water District when the President of Womack Construction serves as a board member of the <br /> Louisiana Rural Water Association and the West Allen Parish Water District is a member of the <br /> Louisiana Rural Water Association. You stated that Womack Construction has submitted the lowest <br /> bid for a contract with the West Allen Parish Water District for a USDA water improvement project. <br /> You stated that the West Allen Parish Water District is a member of the Louisiana Rural Water <br /> Association,a non-profit corporation.You also stated that Glen Womack,the President of Womack <br /> Construction, is president of the Louisiana Rural Water Association Board of Directors. Glen <br /> Womack receives no compensation for his service on the Louisiana Rural Water Association's Board <br /> of Directors. <br /> The Board concluded,with Board member Leggio recused,and instructed me to inform you,that the <br /> Code of Governmental Ethics would not prohibit Womack Construction from entering into a <br /> contract with the West Allen Parish Water District at a time when Glen Womack, President of <br /> Womack Construction, serves as a member of the Louisiana Rural Water Association Board of <br /> Directors and the West Allen Parish Water District is a member of the Louisiana Rural Water <br /> Association. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The Board <br /> issues no opinion as to past conduct or as to laws other than the Code of Governmental Ethics.
